SOUTH BERWICK PLANNING BOARD

RESCHEDULED MEETING MINUTES

January 8, 2008

7:00 PM

ROLL CALL

Dennis Smith (Chairman), Richard Clough, Cheryl Dionne, Mimi Demers, Brad Christo, Bruce Whitney and Jim Fisk (Planner).

Bruce Whitney will be a voting member.

Susie Scott (Administrative Assistant) was taking minutes.

CALL TO ORDER

Chairman Smith called the Planning Board meeting to order at 7:00 PM.

Chairman Smith welcomed Mimi Demers as the new member to the Planning Board.

MINUTES APPROVAL

December 4, 2007 – Regular Meeting: Motion by Ms. Dionne, 2nd by Mr. Christo to accept minutes as amended, passed unanimously with Mr. Clough and Ms. Demers in abstention.

PUBLIC AUDIENCE

- none.

CORRESPONDENCE

1. General Code Book – Supplemental inserts provided by Barbara Bennett, Town Clerk. Susie Scott provided the Board the inserts to be added to Board members’ code books.

NEW BUSINESS

- none.

OTHER

1.      Zoning Updates – Memos (5) from Jim Fisk include: Ordinance updates revised, Accessory Apartments, Major Home Occupations, Official Business Directional Signs and General Provisions. Mr. Fisk provided the Board with a new memo dated January 4, 2008 “Home Occupations in the R3 and R5 zones”.
Chairman Smith discussed the process of updating the zoning ordinance following the comprehensive plan.

Mr. Christo discussed working through goals there were set at the beginning of 2007.

Mr. Clough noted that these updates are zoning amendments to assist with Planning Board decisions.

The Planning Board reviewed and recommended the following changes:

· Accessory Apartment:  Adopt changes to Table A, Land Use.

- Accessory Apartment (6)

- I1 – Yes (6)

- Addition of I2 to Table A

- I2 – Yes (5&6)

- Addition of (6) under Land Use Index.

·  Major Home Occupations, Transitional Residential District – R3: (Need to notify abutters of any zoning change). Adopt changes to Land Use, Table A.

- “N” to “SP” under R5.

· Official Business Directional Signs, Signs: 140-26: Amend ordinance to not allow off-site, Official Business Directional signs, and no longer exempt them under General Provisions. There are no state provisions to regulate sign placement.

- Remove the following sentence from Article V General Performance Standards, Section. 140-26. Signs. D. (4) “…motor vehicle signs requiring Maine DOT approval in accordance with the Maine Travelers Information Service Act”.

- Add “N”

- Existing signs are grandfathered.

· Site Plan Review, General Provisions (peer review).

- Adopt as presented in Jim Fisk memo dated October 16, 2007.

Motion by Mr. Clough to amend the zoning ordinance to include the following amendments to Accessory Apartment, Major Home Occupations, Official Business Directional Signs, and Site Plan Review, General Provisions sections, and forward amendments to the Town Council for approval, second by Ms. Dionne, passed unanimously.

OTHER

1. Planning Board to nominate replacement to the Economic Development Committee following resignation of David Burke. The Planning Board recommended that Mimi Demers be the EDC representative. Mr. Christo requested a brief report every month.

Motion by Mr. Christo to nominate Ms. Demers to be the Planning Board representative on the Economic Development Committee, second by Ms. Dionne, passed unanimous. Planning Board recommendation will be forwarded to the Town Council.

2. SMRPC flyer – Low Impact Development Techniques for Stormwater Treatment seminar: January 23, 2008 at 7:00 PM in Kennebunk, Maine. Flyer received by Planning Board members. Chairman Smith requested an attending Board member take notes and report back to the Board.

MEMBER COMMENTS

Mr. Clough discussed the possibility of exempting parking requirements from Young to Central Streets for new or existing businesses. Residential uses would still have to provide parking for their tenants. The Board agreed to further discuss issue in the future. Chairman Smith would like to hold any further discussion until the Town Council responds to the Planning Board regarding Planning Board parking recommendations.

Motion by Mr. Christo, second by Mr. Clough to adjourn the meeting. The meeting was adjourned without objection at 8:23 PM.
